J. AMELIO, LLC 2000 Village Run Road, #203 Wexford, PA 15090 Agreement between the undersigned client (the “Client”) and J. AMELIO, LLC (“JA”); Client hereby knowingly and willingly assumes the responsibility for any and all risk, damage or injury which may result from engaging in any physical exercise, class or activity and from any use of any program on the premises or otherwise; and hereby knowingly and willingly releases and discharges JA and its owner, members, managers, shareholders, officers, directors, partners, employees, instructors and agents, and their heirs, successors and assigns, and each of them, from any and all claims, damages, or injuries of any nature whatsoever resulting therefrom.
Client acknowledges that the exercises taught at the JA are a valuable property right licensed by JA and agrees and warrants that neither he/she nor anyone under his/her aegis will engage in the instruction of the exercises or any part thereof without the prior written consent of JA.
Client should consult a physician before taking class or using the JA facilities. Client understands and acknowledges that JA and its owner, members, managers, shareholders, officers, directors, partners, employees, instructors and agents, have no expertise in diagnosing, examining or treating any medical condition. Client understands that if she is pregnant or expects to become pregnant at a later date, she must have a doctor’s prior written permission to participate in JA exercise classes and must furnish evidence of such permission to JA before participating in any classes or using the JA facilities.
Client agrees to make payment for individual classes or courses before class and understands that there will be no refunds for amounts paid for classes. JA warrants that pre-paid courses are good for one year and are not transferable. Any reservations cancelled less than 1 hour in advance will be charged for.
Client acknowledges the risk associated with exercising in a public space and the potential exposure to germs and viruses. Client releases J Amelio, LLC from any reasonable liability resulting in the client contracting a sickness while attending classes at the studio.
If an employee or customer of the studio contracts COVID-19, we may be required to share personal information with federal, state and/or local government agencies. Employees and customers will be notified if their information is shared with a government agency. If it is deemed necessary for the safety of other members of the studio community, we will inform our community, using minimal personal information, of the exposure so individuals may assess their own personal health and exposure risk. The minimal amount of personal information necessary is context-specific and may change depending on the circumstances.
The studio offers some live streamed and recorded video classes. You grant permission for us to live stream, record, and playback your participation in these classes. Also, you, on behalf of yourself and any member of your household whom you permit to access such videos, agree to (i) assume all risks, including the loss or damage to property and risk of physical injury, emotional distress, or even death, and (ii) solely bear the cost of any such injury or loss. You waive rights to any claims including defamation, false light, invasion of privacy, rights of publicity, injury, and any tort claim or claims related to this service.
FOR ALL CLASS PARTICIPANTS FOR EITHER J. AMELIO LLC OR MAUREEN ELIZABETH LLC:
I grant J Amelio LLC d/b/a Studio Beyond (“J Amelio LLC”) and Maureen Elizabeth LLC d/b/a Be Me – educate.motivate.move (“Maureen Elizabeth, LLC”) permission to use likeness or the likeness of minor participant(s), in photographs, videos, or other digital media (collectively “Imagery”) in any and all of its publications, including web-based publications or social media, without payment or other consideration.
I understand and agree that all Imagery will become the shared property of J Amelio LLC and Maureen Elizabeth, LLC and will not be returned.
I hereby irrevocably authorize the J Amelio LLC and Maureen Elizabeth, LLC to edit, alter, copy, exhibit, publish, or distribute this Imagery for any lawful purpose. In addition, I waive any right to inspect or approve the finished product wherein my likeness (or the likeness of my minor participant(s) listed below) appears. Additionally, I waive any right to royalties or other compensation arising or related to the use of the Imagery.
I hereby hold harmless, release, and forever discharge J Amelio LLC, Maureen Elizabeth, LLC, Studio Beyond, LLC, and each of their respective parents, subsidiaries, affiliates, predecessors, successors, partners, officers, members, managers, directors, employees, volunteers, representatives, and assigns (collectively, the “Indemnified and Released Parties”) from all claims, demands, and causes of action which I, my heirs, representatives, executors, administrators, or any other persons acting on my behalf or on behalf of my estate have or may have by reason of use of the Imagery or this authorization.
THE UNDERSIGNED HEREBY REPRESENTS, WARRANTS AND COVENANTS THAT: (I) HE OR SHE HAS FULLY READ AND UNDERSTANDS EACH PROVISION OF THIS PHOTO RELEASE; (II) HE OR SHE HAS BEEN GIVEN A SUFFICIENT AND REASONABLE TIME TO CONSIDER IT; (III) NO ORAL REPRESENTATIONS, STATEMENTS, OR INDUCEMENTS APART FROM THOSE SET FORTH IN THIS PHOTO RELEASE HAVE BEEN MADE BY THE INDEMNIFIED AND RELEASED PARTIES; AND (IV) HE OR SHE HAS RELIED UPON HIS OR HER OWN ADVICE OR THE ADVICE OF HIS OR HER OWN ATTORNEY IN CONNECTION WITH HIS OR HER EXECUTION OF THIS PHOTO RELEASE.
